Terms and Conditions

1. Introduction

1.1 Please read these terms of use (hereinafter referred to as "Terms") carefully before accessing and/or using the App and/or Site and/or Platform (hereinafter defined). These Terms govern your rights and obligations (whether as a guest or a registered user) in relation to the access and/or use of SEJAMAS website, the App and/or Site, and/or mobile application (collectively referred to as "Platform") and SEJAMAS Services (as defined below). These Terms constitute a legally binding agreement between the Company (operating under the brand name "SEJAMAS"), being the proprietor of all rights in and to the Platform and/or Services, and you, being the user of the Platform and/or Services.

1.2 SEJAMAS is an online to offline service provider that provides customers with motor vehicle battery changing service by its own technicians, whereas for Outsourced Services, SEJAMAS offers those services through third-party independent contractors. On certain occasions where the demand for SEJAMAS's Services is too high, SEJAMAS has the right to outsource SEJAMAS's Services to independent third-party contractors.

1.3 By accessing, browsing, downloading, and/or using the Platform and/or Services, you acknowledge that you have agreed to comply with and be bound by these Terms, including such other terms amended and incorporated from time to time.

1.4 We may revise, amend, or update these Terms at any time by posting a revised or updated version on the Platform. Unless stated otherwise, any revision or update takes effect immediately. Your continued access and/or use of the Platform and/or Services constitutes your acceptance of the revised or updated Terms.

1.5 We may change or update the Platform and/or Services and any information on the Platform and/or Services at any time without notice to you or liability to us. We may also suspend, discontinue, or restrict access to the Platform and/or Services temporarily or permanently at any time without notice to you or liability to us.

1.6 Service Hours: Service is available between 9 AM to 6 PM daily. Emergency services outside these hours may be subject to additional charges, all to be borne by you.

2. Price and Payments

2.1 Price: All prices listed on the Platform are in Malaysian Ringgit. The price of each Service is listed on the Platform. In the event there is any service beyond what was agreed upon, SEJAMAS's contact center will inform you of the charges and obtain your agreement before providing the Services to you.

2.2 Payment methods: All payment for the Services (together with taxes, if any) shall be payable by you by way of online transfer only.

2.3 Taxes: If the Service is subject to taxes as may be imposed by the law of Malaysia, you shall be responsible to pay for the taxes in addition to the price for the Service.

2.4 No refunds: Purchases made by you are non-refundable. We will not refund or credit for any Service rendered unless you provide credible evidence to us to prove that you have been wrongly billed or under such other circumstances subject to a "case-by-case" basis. Our decision as to whether to refund shall be final and binding, and we shall be under no obligation whatsoever to assign any reason or reasons for the decision. Any refund, if approved, will be refunded to your account within 14 working days from the date of our approval.

2.5 Minimum service charge: In the event SEJAMAS's technician is called to your location but is unable to provide the Services due to unforeseen circumstances beyond his/her control, you shall be responsible for paying a minimum service charge of RM30.00.

2.6 Vouchers: We may from time to time provide vouchers for our customers as part of our promotional campaigns. The vouchers are not exchangeable, convertible, or redeemable for cash.

3. Response Time

While we can show or update an estimated time of arrival of SEJAMAS's technician to your exact geographical location provided by you, it is merely an estimated time and shall not be taken as a binding commitment from SEJAMAS. The response time depends on various factors including, but not limited to, traffic conditions, road accidents, the distance from SEJAMAS office to your exact geographical location, and other road conditions. In any event, SEJAMAS's technician will strive to reach your exact geographical location in the shortest possible time but will not be liable if SEJAMAS's technician reaches your location beyond the estimated time of arrival. Delivery of replacement batteries will be provided within government-gazette roads only.

4. Your Obligations

4.1 You must at all times comply with any instructions for use of the Platform and/or Services implemented by us from time to time.

4.2 You must provide true, current, and complete information in your dealings with us (including when setting up an account) and must promptly update that information as required so that the information remains true, current, and complete.

4.3 You agree that you are solely responsible for:

• 4.3.1 All costs and expenses you may incur in relation to your use of the Platform and/or Services;
• 4.3.2 Keeping your password and other account details secure and confidential.

4.4 Tampering: The warranty is void if the battery is tampered with or modified in any way whatsoever.

4.5 Notification of Issues: You must notify the service center immediately upon noticing any battery-related issues. Delays in reporting may affect the response time and service quality or may render the warranty void.

4.6 We will ensure the Platform is available and accessible as much as possible. However, if you have any difficulties in accessing and using the Platform, please do not hesitate to contact us at customerservice@sejamasgroup.com.my.

5. Disclaimers

5.1 The information and materials on the Platform are provided to you for information purposes only and on an "as is" and "as available" basis without representations, warranties, or guarantees of any kind, either express or implied.

5.2 While we endeavor to make the Platform (excluding the Services) available 24 hours a day, we shall not be liable if for any reason the Platform is unavailable at any time or for any period. We make no representation, warranty, or guarantee that your access to the Platform will be uninterrupted, timely, or error-free. Due to the nature of the internet, this cannot be guaranteed. In addition, we may occasionally need to carry out repairs, maintenance, or introduce new facilities and functions.

5.3 We warrant that the Services will be performed consistent with generally accepted industry standards. No specific result from the provision of the Services is assured or guaranteed. Other than those expressly set forth herein, to the extent permitted by law, we hereby disclaim all warranties, express or implied, statutory or otherwise, including but not limited to implied warranties and the warranties of merchantability, fitness for a particular purpose, in respect of the Platform and/or Services.

5.4 Alternative product: In the event that the product advertised on the Platform is out of stock, we may recommend to you an alternative product as a replacement, the quality of which will be verified by our technician and informed to you before installation.

5.5 Replacement Battery Specifications: Replacement batteries provided under this program will be equivalent specifications to the original manufacturing standard battery. Any upgrades requested by the customer will incur additional charges. Any request for a different battery brand that is not the same as the one provided will also incur additional costs.

5.6 Replaced faulty batteries will be the property of SEJAMAS. If you refuse to provide the faulty battery to SEJAMAS, we have the right to levy a minimum charge of RM35.00 or more depending on your subscribed vehicle. A faulty battery means a battery that is malfunctioning, defective, damaged, or broken due to normal daily usage or manufacturing defects. A battery that has become faulty due to damage caused by improper installation or charging, accident, external impact, or your negligence will be rejected by us.

5.7 When a car battery replacement is requested and assigned, the faulty battery must be present in its untampered position and intact to your vehicle during the inspection and replacement process.

5.8 Your subscription is non-transferable and is personal to you together with the vehicle registered.

6. Intellectual Property

6.1 We are the owner of all proprietary and intellectual property rights on the Platform (including all information, text, visual data, graphics, artworks, logos, sound recordings, videos, icons, look and feel, software programs, computer code, software applications, downloadable files, interactive features, tools, and services) or other information or content made available on or through the Platform.

6.2 We grant you, subject to these Terms, a non-exclusive, non-transferable, non-assignable, personal, limited license to access and use the Platform for your own personal and non-commercial use. All rights not expressly granted to you are reserved by us.

7. Exclusion of Liability

7.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), we are not legally responsible for any losses that were:

• 7.1.1 Not foreseeable to you and SEJAMAS when this contract was formed;
• 7.1.2 Not caused by any breach on SEJAMAS's part; and
• 7.1.3 Indirect, exemplary, incidental, or consequential loss (including loss of profit and loss of data) arising out of or in connection with the Platform and/or Services.

7.2 We have no liability to you for any breach of these terms caused by any event or circumstance beyond our reasonable control, including but not limited to strikes, lockouts, or other industrial disputes, breakdown of systems or network access, or flood, fire, explosion, or accident.

7.3 Exclusions: The warranty does not cover batteries damaged due to accidents, misuse, natural disasters, or unauthorized repairs.

7.4 Maintenance of your battery is limited to your subscription period with SEJAMAS.

8. General

8.1 If we need to contact you, we may do so by email or by posting a notice on the Platform. Notice will be deemed given 24 hours after the email is sent to your designated email address or notice is posted on the Platform. You agree that this satisfies all legal requirements in relation to written communications.

8.2 These Terms and our Privacy Policy constitute the entire agreement between you and SEJAMAS and supersede any prior agreements, arrangements, statements, and understandings between SEJAMAS and you.

8.3 Any waiver of our rights under these Terms shall be in writing.

8.4 Any term, condition, stipulation, provision, covenant, or undertaking herein which is illegal, void, prohibited, or unenforceable shall be ineffective to the extent of such illegality, voidness, prohibition, or unenforceability without invalidating the remaining provisions hereof, and any such illegality, voidness, prohibition, or unenforceability shall not invalidate or render illegal, void, or unenforceable any other term, condition, stipulation, provision, covenant, or undertaking herein contained.

9. Retention

We will retain the information you provide for as long as we need it to provide you with the Services. If you delete your account, we will also delete this information. Notwithstanding that, please note that:

• 9.1 There might be some latency in deleting this information from our servers and backup storage;
• 9.2 We may retain this information as it may be necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

10. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Malaysia, and each party agrees to submit to the non-exclusive jurisdiction of the Courts of Malaysia.
